Version 2.0 | Effective date: 12 October 2026 | Website: dolce-casa.com | Contact: biuro@platiniumestate.pl

§ 1. General Provisions

  1. These Terms and Conditions set out the rules for using the DOLCE CASA website available at dolce-casa.com (hereinafter: the “Website”). At dolce-casa.pl and dolce-casa.eu, the Website is accessible by way of automatic redirection.
  2. The Operator and service provider is PLATINIUM ESTATE & YACHTS Sp. z o.o., ul. Floriańska 6/02, 03-707 Warszawa, KRS 0000630211, NIP 1132915056, REGON 365063325; e-mail: biuro@platiniumestate.pl.
  3. The Website presents listings of real estate located in Poland and abroad, including flats, houses, apartments, land, commercial premises and property development projects, offered for sale or for rent.
  4. These Terms and Conditions are made available free of charge in a form that allows them to be downloaded, stored and reproduced.

§ 2. Definitions

  • User – a person using the Website;
  • Account – the individual profile of a registered User;
  • Agency – an entity providing services on the real estate market;
  • Agent – an authorised person acting within an Agency;
  • Developer – an entity that independently publishes and manages listings of its own development projects or properties;
  • Partner – an Agency, a Developer or another entity cooperating with the Operator;
  • Advertiser – an entity publishing an advertisement;
  • Connection – an assignment to an Agency within the Website, accepted by the User.

§ 3. Nature and Functions of the Website

  1. The Website makes it possible to browse, search and compare listings, create Accounts, send enquiries and establish cooperation with Agencies. The User may use the Account without a Connection with an Agency.
  2. Using the Website, sending an enquiry or entering into a Connection with an Agency does not in itself constitute the conclusion of a sale, lease, reservation or brokerage agreement; any such agreements are concluded separately.

§ 4. Technical Requirements and Security

  1. Using the Website requires a device with Internet access, an up-to-date browser supporting basic web standards and an active e-mail address for the registration and maintenance of the Account. Certain functions may require JavaScript and necessary cookies to be enabled.
  2. The User may not provide unlawful content, compromise the security of the Website, attempt to gain unauthorised access or use the Accounts of other persons.

§ 5. Registration and User Account

  1. The User registers the Account themselves by providing the data required in the form and completing the prescribed verification steps. The agreement for the maintenance of the Account is concluded upon completion of registration and once the Account has been made available.
  2. The Account is maintained by the Operator and is not the property of any Agency. Using the Account does not require a Connection with an Agency. The User shall keep their data up to date and their login credentials confidential.
  3. The Operator may temporarily restrict access to the Account in the event of a breach of the law or of these Terms and Conditions, or of a threat to security, in compliance with applicable law and subject to providing the required information.

§ 6. Connection with an Agency

  1. An Agency may send the User an invitation to a Connection. A Connection is established only once the User has accepted the invitation by e-mail. Before accepting, the User is informed of the identity of the Agency and of the Agent who sent the invitation; the scope of the data shared is set out in paragraph 2.
  2. Within an active Connection, authorised Agents may obtain access to the User’s first name, last name, e-mail address, telephone number, information on their property interests, notes and service history, to the extent made available on the Website. The Agency may transfer the handling of the User to another authorised Agent of the same Agency.
  3. Acceptance of a Connection does not constitute consent to electronic marketing. The Agency is responsible for the lawfulness of its own data processing and of its own commercial communications.

§ 7. Termination of a Connection

  1. The Agency may cease handling the User; termination of the Connection results in the Agency losing access to the data shared within the active Connection on the Website. The User’s Account remains active.
  2. The User may request termination of the Connection by contacting the Operator at biuro@platiniumestate.pl.
  3. Another Agency may request a Connection, which requires separate acceptance by the User. Termination of a Connection does not automatically terminate any separate agreements between the User and the Agency, nor does it erase data which the Agency lawfully retains as a separate controller.

§ 8. Ceasing Use and Deletion of the Account

  1. The User may at any time submit an instruction to delete the Account in the Website settings; the Operator may also be contacted for this purpose at biuro@platiniumestate.pl. Deletion of the Account terminates the Account maintenance service and any active Connections with Agencies.
  2. Data are erased or anonymised, except for data retained on a separate legal basis, e.g. for the purposes of statutory obligations or claims. Deletion of the Account does not automatically entail the deletion of data stored by an Agency outside the Website. Details are set out in the Privacy Policy.
  3. The instruction to delete the Account is submitted after logging in, in the Account settings, and is confirmed in the window displayed. The Account is closed without delay: it is no longer possible to log in, and the e-mail address is removed from the Account – the Operator retains only its cryptographic hash so as to be able to link any subsequent data-related request to the closed Account. The Operator permanently deletes the remaining Account data upon a request sent to biuro@platiniumestate.pl, without undue delay and in any event no later than one month after receipt of the request, and confirms the deletion by e-mail. Data held in backup copies are overwritten in a cycle not exceeding 30 days.

§ 9. Partner Accounts and Self-Publication of Properties

  1. Agencies and Developers may independently add, edit, update and publish property listings within the permissions granted to them. The Operator may also make these functions available to other authorised Partners.
  2. The Advertiser is responsible for the listing being lawful, reliable, complete and up to date, for its right to offer the property, and for holding the rights to the photographs, descriptions, videos, visualisations and other materials. The Advertiser is obliged to keep prices and availability up to date and to remove outdated advertisements.
  3. Content that is unlawful, infringes the rights of third parties, is misleading or does not comply with these Terms and Conditions is prohibited. The Operator may moderate content in accordance with §§ 10–11. The terms of paid cooperation with Partners, if any, are set out in a separate agreement or in a price list made available before the agreement is concluded.

§ 10. Notification of Illegal Content

  1. Any person may report content they consider to be illegal by e-mail to biuro@platiniumestate.pl. The notice should include a statement of reasons, the exact location of the content (e.g. its URL), the contact details of the notifier, save in cases provided for by law, and a statement confirming the notifier’s bona fide belief that the notice is accurate and complete.
  2. The Operator handles notices in a timely, diligent, objective and non-discriminatory manner; it may leave the content in place, restrict its visibility or access to it, or remove it. Where required by law, it informs the notifier of its decision and of the available means of appeal.

§ 11. Moderation, Statement of Reasons and Appeals

  1. The Operator may restrict the visibility of or remove a listing, restrict the provision of the service or suspend an Account on the grounds that content is unlawful or that these Terms and Conditions have been breached, within the limits of the law. Where required, it provides the party concerned with a statement of reasons for the decision and with information on the available means of redress.
  2. If the Operator is subject to the obligation to operate an internal complaint-handling system under the Digital Services Act (DSA), it makes that system available together with information on the time limit for and method of lodging a complaint; irrespective of this, the relevant out-of-court and judicial remedies remain available.

§ 12. Listings and Foreign Properties

  1. Listings may concern properties located in Poland and abroad. Photographs, visualisations, floor areas and descriptions may be illustrative, provided that this has been appropriately indicated. Prices and availability are subject to change; publication does not guarantee that the property is available.
  2. Information on taxation, law and financing is of a general nature and does not replace individual advice. Before entering into a transaction, the User should verify the legal and factual status of the property, the costs involved and the applicable law.
  3. Currency conversions are indicative only; the final value of a transaction depends on the exchange rate applied at settlement.

§ 13. Rights to Content and the Database

  1. The content of the Website, its layout, designations and database are protected by law. The Advertiser retains the rights to its materials and grants the Operator a non-exclusive, royalty-free licence to store, reproduce and make them available to the public on the Website for the duration of the publication of the advertisement, to the extent necessary to provide the service.
  2. The systematic copying or re-utilisation of a substantial part of the listings database without authorisation is prohibited, except where permitted by law.

§ 14. Liability

  1. The Operator is liable for its own services in accordance with the law. The Advertiser is liable for the content it publishes. The Operator does not guarantee that a transaction will be concluded or that a property will be available at the time of contact.
  2. No provision of these Terms and Conditions excludes the Operator’s liability or the rights of a consumer to the extent that such exclusion would be impermissible under the law.

§ 15. Complaints and Contact

  1. Complaints concerning the Website may be submitted to biuro@platiniumestate.pl. A complaint should contain a description of the problem and details enabling a response to be given. The Operator handles complaints without undue delay and within the time limits laid down by the applicable law.
  2. Complaints concerning services provided by an Agency or a Developer under a separate agreement may be addressed directly to the entity concerned. The complaints procedure does not limit the User’s statutory rights.

§ 16. Personal Data

  1. The controller of the data processed for the purposes of maintaining Accounts and operating the Website is PLATINIUM ESTATE & YACHTS Sp. z o.o. Agencies and Developers may be separate controllers to the extent that they independently determine the purposes and means of the processing.
  2. The rules governing data processing, the sharing of data with Partners, data retention and cookies are set out in the DOLCE CASA Privacy Policy and Cookies Policy.

§ 17. Amendments to the Terms and Conditions and Final Provisions

  1. The Operator may amend these Terms and Conditions for valid reasons, in particular as a result of changes in the law, in the scope of services, in functionality or in security requirements. The Operator informs Users of amendments in advance, as required by the applicable law, in a manner that enables them to become acquainted with the new wording.
  2. These Terms and Conditions are governed by Polish law, without prejudice to mandatory provisions protecting consumers. They enter into force on the date indicated at the beginning of these Terms and Conditions.
